Personal data protection under the GDPR

In compliance with current legislation on personal data protection, Frial Technologies S.L informs users that all personal data collected via the forms on the website will be included in specific automated files of users of the services provided by Frial Technologies S.L.

The purpose of the collection and automated processing of users’ personal data is to maintain the commercial relationship and to enable the delivery of information, training, advice, and other activities by Frial Technologies S.L.

These data will only be transferred to other entities when necessary and solely for the purpose set out above.

Frial Technologies S.L adopts the necessary measures to guarantee the security, integrity and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing the former LOPD, the new Organic Law 3/2018, of 5 December, on Data Protection and the Guarantee of Digital Rights (LOPDGDD).

The user may exercise their right to access, rectify, cancel, oppose, limit, or transfer their data at any time under the aforementioned Regulation (EU). They may do so by emailing or writing to C/ Faraday, 7, C.P. 28049 – Madrid (Madrid, Spain).

The user states that all personal data provided are true and correct and undertakes to update them where necessary, informing Frial Technologies S.L of any changes.

Why do we process your personal data?

At Frial Technologies S.L, we will process the personal data provided by users via the website for the following purposes:

  1. To comply with the company’s commercial, labour, corporate and accounting obligations.
  2. To provide services in accordance with the particular needs of the company’s customers and fulfil the contracts it has signed.
  3. To send commercial information and newsletters about new services available on the website and about the sector more generally.
  4. To fulfil a contract signed remotely with the user.
  5. To facilitate purchases of the products advertised on the website.
  6. To deliver the services booked by the user.
  7. To send promotional information electronically.
  8. To provide the information requested by the user via the contact form.

You are entitled to oppose the sending of commercial communications via any channel at any time by emailing the address listed above.

All fields must be completed, as it will not be possible to fulfil the aforementioned purposes without the requested data.

How long will personal data be stored?

The personal data provided will be kept for as long as the commercial relationship is maintained and the user does not request their deletion, and for as long as the company remains legally responsible for the services provided.


Processing of your personal data is legitimated on the following legal grounds:

  1. Requesting information and/or booking services from Frial Technologies S.L, which will provide all relevant terms and conditions for your consideration prior to any booking.
  2. Free, specific, informed and unequivocal consent based on the information supplied in this privacy policy, which you may choose to accept after reading via a statement or a clear affirmative action such as ticking the box provided for this purpose.

In the event that you do not provide your data or that you provide incorrect or incomplete data, we will not be able to fulfil your request and it will not be possible to give you the requested information or book the required service.


Data will not be passed on to any third party external to Frial Technologies S.L unless there is a legal obligation to do so.

Data collected by service users:

Frial Technologies S.L will take no responsibility for any breaches of the GDPR by the user in the event that they upload files containing personal data to shared hosting servers.

Data retention under the LSSI:

Frial Technologies S.L informs users that, as a data hosting service provider and under Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), it will retain the information required to identify the origin of the data hosted and the date and time when the service commenced for a maximum period of 12 months. Retention of these data does not affect respect for the confidentiality of communications and they may only be used as part of a criminal investigation or to guarantee public safety when requested by a judge and/or the courts or the relevant government ministry. Data will be transferred to the law enforcement authorities in accordance with data protection laws.

Intellectual property rights to

Frial Technologies S.L is the owner of all copyrights, intellectual and industrial property rights, know-how and any other rights relating to the content of the website and the services offered therein, as well as of the programmes required to implement these services and all related information.

Reproduction, publication and/or use (unless strictly private) of the content of the website, in whole or in part, is forbidden without prior written consent.

Intellectual property of the software

The user must respect the third-party programmes provided by Frial Technologies S.L, even when these are free and/or publicly available.

Frial Technologies S.L holds the necessary exploitation and intellectual property rights to the software.

The user does not acquire any right or licence to the service they have booked, to the software required to deliver the service or to the technical information needed to monitor the service, with the exception of the rights and licences necessary to provide the services booked for the duration of the booking only.

Any actions that exceed the scope of the contract will require written authorisation from Frial Technologies S.L and the user is forbidden from accessing, modifying or viewing the configuration, structure and files held on the servers belonging to Frial Technologies S.L, taking full civil and criminal responsibility for any issues occurring with the servers and security systems as a direct consequence of negligent or malicious action on their part.

Intellectual property of the content hosted

Any use of the services provided by Frial Technologies S.L that represents a breach of intellectual property legislation is prohibited, especially:

  1. Any use that contravenes Spanish law or infringes third party rights.
  2. Publication or broadcast of any content considered by Frial Technologies S.L to be violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.
  3. Cracks, programme serial numbers or any other content that violates third party intellectual property rights.
  4. Collection and/or use of personal data belonging to other users without their express consent or in contravention of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
  5. Use of the domain’s mail server and email addresses for sending unsolicited bulk email.

The user is fully responsible for all content on their website, the information published and stored, the hyperlinks, third party claims and lawsuits relating to intellectual property, third party rights and child protection.

The user is responsible under the current laws and regulations governing the operation of online services, electronic commerce, copyrights, maintenance of public order, and the universal principles of internet use.

The user will compensate Frial Technologies S.L for the costs incurred by charges brought against Frial Technologies S.L in any lawsuit in which responsibility was attributed to the user, including legal defence fees and costs, even in the case of a non-final order.

Protection of the information stored

Frial Technologies S.L keeps security copies of the content stored on its servers, but it will not take responsibility for the loss or accidental deletion of data by users. Equally, it does not guarantee full replacement of the data deleted by users, as the data may have been deleted and/or modified in the time that has elapsed since the last security copy was made.

The advertised services, with the exception of specific backup services, do not include replacement of content stored on the security copies made by Frial Technologies S.L when this loss is attributable to the user; in this case, a fee reflecting the complexity and volume of the recovery will be set subject to acceptance from the user.

Replacement of deleted data is only included in the price of the service when the loss of content is attributable to Frial Technologies S.L.

Commercial communications

In compliance with the LSSI, Frial Technologies S.L will not send marketing or promotional communications by email or any other equivalent electronic communication channel unless previously requested or expressly authorised by the recipient to do so.

In the case of users with whom there is an existing contractual relationship, Frial Technologies S.L is authorised to send commercial communications relating to products or services offered by Frial Technologies S.L that are similar to those initially purchased by the customer.

In any case, the user may request to stop receiving commercial information by contacting the Customer Service department and providing the relevant ID.
